1. Acceptance of Terms

By installing or using SIZErise (“the App”), you agree to these Terms of Service. SIZErise is operated by Appsarise. If you do not agree, do not install or use the App.

2. Description of Service

SIZErise is a Shopify application that provides AI-powered shoe size recommendations to your customers based on their foot measurements and your product data. Recommendations are generated by artificial intelligence and are advisory in nature.

3. Subscription and Billing

SIZErise offers paid subscription plans (Pro and Scale) billed through Shopify's billing system. Charges appear on your regular Shopify invoice. All plans include a 14-day free trial with no credit card required. You may cancel at any time through the SIZErise admin panel. Cancellation takes effect at the end of the current billing period.

4. Usage Limits

Each plan includes a monthly limit on the number of size recommendations (“fits”). When the limit is reached, the size finder will show a friendly “temporarily unavailable” message to customers. You can upgrade your plan at any time to increase your limit.

5. Accuracy Disclaimer

Size recommendations are generated by AI and are provided as guidance only. SIZErise does not guarantee that every recommendation will result in a perfect fit. Actual fit may vary based on factors including but not limited to individual foot shape, sock thickness, and personal preferences. We are not liable for returns, exchanges, or customer dissatisfaction resulting from size recommendations.

6. Merchant Responsibilities

• Provide accurate shoe fit profile information
• Maintain an active Shopify store in good standing
• Comply with applicable consumer protection laws
• Not misrepresent AI recommendations as medical or professional advice

7. Intellectual Property

SIZErise, including its algorithms, design, and branding, is the property of Appsarise. Your product data and customer data remain your property. By using the App, you grant us a limited license to process your data as necessary to provide the service.

8. Limitation of Liability

To the maximum extent permitted by law, Appsarise shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of SIZErise. Our total liability shall not exceed the amount paid by you for the App in the 12 months preceding the claim.

9. Termination

Either party may terminate this agreement at any time. You can uninstall the App through the Shopify admin. We may suspend or terminate your access if you violate these terms or misuse the service.

10. Governing Law

These terms are governed by the laws of Australia. Disputes shall be resolved through good-faith negotiation before any formal proceedings.
